PUBLIC HEARINGS:
1. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON A REQUEST TO AMEND THE CITY’S GENERAL PLAN DESIGNATING THE PROPERTY LOCATED AT 982 WEST 1600 SOUTH (TIN: 12-391-0010) FROM COMMERCIAL TO RESIDENTIAL BACKGROUND: The applicant is requesting a general plan amendment from commercial to residential to redevelop the property with townhomes. With a property area of 0.78 acres, if the request is approved then a total of twelve townhomes could be constructed on the site. RECOMMENDATION: Receive public comment.
2. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON REZONING THE PROPERTY LOCATED AT 982 WEST 1600 SOUTH (TIN: 12-391-0010) FROM C-2 (COMMERCIAL) TO R-3 (RESIDENTIAL) BACKGROUND: The City received a request to rezone the property to redevelop the property with townhomes. With a property area of 0.78 acres, if the request is approved then a total of twelve townhomes could be constructed on the site. The applicant has provided a conceptual site plan with thirteen townhomes on the site. Each of the townhomes would have rear-loaded garages with seven along the north property line and six along 1600 South. The applicant has indicated a willingness to enter into a development agreement to dictate the design of the townhomes and would consider designing the townhomes to match the Wilcox Farms subdivision. RECOMMENDATION: Receive public comment.
3. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON THE ADOPTION OF WATER AND SEWER IMPACT FEE STUDIES, REPORTS, AND FEES (CONTINUED) BACKGROUND: The City began looking at its water and sewer impact fees in 2021 because of all the growth currently taking place. JUB Engineers and Zions Bank performed a comprehensive study and draft Facilities Plan and Impact Fee Analysis for both utilities. The Analyses recommend increases to the impact fees. This public hearing is to receive public comment on the proposed changes to the impact fees and the associated Facilities Plans. This public hearing was continued from the meeting on July 11, 2023. RECOMMENDATION: Receive public comment.

4. OPEN COMMENT PERIOD The Open Comment Period provides an opportunity to address the Mayor and City Council regarding concerns or ideas on any topic. To be considerate of everyone at this meeting, public comment will be limited to three minutes per person. Participants are to state their names for the record. Comments, which cannot be made within these limits, should be submitted in writing to the City Recorder at nancy.dean@clearfieldcity.org. The Mayor and City Council encourage civil discourse for everyone who participates in the meeting.

Approve Ordinance 2023-14 amending the City’s General Plan Future Land Use Map designating the property located at 982 West 1600 South (TIN: 12-391-0010) from Commercial to Residential and authorize the Mayor’s signature to any necessary documents; 2. Deny the request amending the City’s General Plan Future Land Use Map designating the property located at 982 West 1600 South (TIN: 12-391-0010) from Commercial to Residential. 3. Table consideration of the request amending the City’s General Plan Future Land Use Map designating the property located at 982 West 1600 South (TIN: 12-391-0010) from Commercial to Residential.

Approve Ordinance 2023-15 rezoning the property located at approximately 982 West 1600 South (TIN: 12-391-0010) from C-2 (Commercial) to R-3 (High Density Residential) and amend the Clearfield City Zoning Map accordingly, and authorize the Mayor’s signature to any necessary documents. 2. Deny the request to rezone the property located at approximately 982 West 1600 South (TIN: 12-391-0010) from C-2 (Commercial) to R-3 (High Density Residential) and amend the Clearfield City Zoning Map accordingly. 3. 8. CONSIDER APPROVAL OF ORDINANCE 2023-11 ENACTING A CULINARY WATER IMPACT FEE FACILITIES PLAN AND SANITARY SEWER IMPACT FEE FACILITIES PLAN, PROVIDING FOR THE CALCULATION AND COLLECTION OF SUCH FEES, PROVIDING FOR APPEAL, ACCOUNTING, AND SEVERABILITY OF THE SAME, AND OTHER RELATED MATTERS; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE RECOMMENDATION: Approve Ordinance 2023-11 enacting a Culinary Water Impact Fee Facilities Plan and Sanitary Sewer Impact Fee Facilities Plan, providing for the calculation and collection of such fees, providing for appeal, accounting, and severability of the same, and other related matters; providing for repealer; providing for severability; and providing for an effective date; and authorize the Mayor’s signature to any necessary documents.

The updated study was completed and reviewed by the Council during its work session on June 27, 2023. Staff is proposing increases based on the analysis for development impact fees. RECOMMENDATION: Approve Ordinance 2023-13 amending the City’s Consolidated Fee Schedule to adjust the Development Impact Fees; and authorize the Mayor’s signature to any necessary documents.
